New York Medical Malpractice And Labor And Delivery Errors

OB-GYNs are one of the most sued medical specialties. So are OB-GYN residents, nurses, physician assistants, and other healthcare professionals. This is generally because labor and delivery is a very difficult process, and there could be errors that affect both the mother and the baby which can result in New York medical malpractice. There are many risks that need to be guarded against during the labor process, and most can easily be mitigated or completed avoided. This type of medical malpractice claim could be against the healthcare providers or the hospital, practice clinic, or other business that healthcare is rendered through.

OB-GYN medical malpractice occurs when there is a failure by the labor and delivery staff, such as the doctor, nurses, or other healthcare professionals, during the birthing process. Some common types of OB-GYN medical malpractice include the following:

• Misdiagnosis of a fetal condition such as a birth defect or genetic disorder during pregnancy;
• Failure to diagnose a fetal condition or a condition of the mother which can greatly increase the risk of birth injuries or death;
• Failure to perform a timely c-section, or failure to recognize the need to perform a c-section;
• Excessive use of forceps of improper use of forceps;
• Failure to diagnose and treat serious prenatal conditions such as ectopic pregnancies;
• Failure to diagnose an umbilical cord condition or complication such as a rupture, compression, or other defect;
• Improperly pulling the baby or excessive force used to deliver the baby causing brachial plexus injuries;
• Incorrectly attempting a birth when the baby is in the wrong station or the mother is not properly dilated;
• Failing to recognize fetal distress;
• Causing brain damage to the baby;
• Failing to recognize or treat maternal bleeding; and
• Other serious birth injuries.

As you can see, there are many different types of OB-GYN instances which can cause medical malpractice. These can largely be avoided or prevented by careful treatment following the standard of care.
