Orthopedic Malpractice Is Very Serious And Very Painful

Orthopedic medicine focuses on patients who need surgery to correct defects or injuries related to their musculoskeletal system.  Orthopedists go through years of general training after medical school, as well as specific training in orthopedic surgery.  This should give the practitioner of orthopedic surgery significant experience.  However, as the patients of one Bronxville orthopedist know, medical negligence can still occur.

After being charged with negligence, a Bronxville orthopedist has been sanctioned by the State of New York and has been placed on professional probation.  He has also been required to complete a clinical competency assessment prior to being able to treat patients.

The orthopedist had been cited for treatment of five patients between the years 2004 and 2011.  The Board for Professional Medical Conduct stated that that doctor had “deviated from minimally acceptable standards of care.”  He had failed to treat and evaluate patients properly and was also cited for his failure to maintain accurate patient records.

Orthopedic surgery malpractice can occur for a variety of reasons.  The surgeon may wait too long to operate, resulting in injury to the patient.  On the other hand, the surgeon may operate when it is not medically necessary to do so, leading to negative results other than undergoing an unnecessary surgery.

When someone suffers an orthopedic trauma, the risk that the patient will experience an embolism or blood clot increases.  Patients with a fracture have an increased risk of developing a blood clot, and these blood clots can develop into a pulmonary embolism.

Malpractice can also occur when the surgeon fails to be aware of the signs and symptoms of an infection after an operation.  The surgeon may also fail to adequately treat infection or refer their patient for treatment of the infection.  By failing to convey to the patient the risks and alternatives that are available, the orthopedic surgeon could be engaging in medical malpractice.
