Back Injuries Caused by New York Medical Malpractice

Your back and spine is incredibly important.  Everything you do relies on your back and spine.  This includes sitting, standing, walking, but also acts like carrying grocery bags, cooking, or even brushing your teeth.  When your back is out you cannot do any of these activities without great pain and difficulty.

This is particularly true for spinal cord injuries.  When your spinal cord has been injured or is being compressed, all of the nerves which originate from the spinal cord in the area of the injury may also be irritated, damaged, and causing severe pain.  Because of this, victims of spinal cord injuries may be entitled to serious compensation for pain and suffering, medical bills, lost wages, and other damages.

But how does New York medical malpractice cause spinal cord injuries?  There are several negligent acts or omissions by a healthcare provider which may result in spinal cord injuries, which include the following:

  • Failure to diagnose a condition such as a tumor or hematoma in the spine or spinal cord;
  • Negligently performing a disectomy;
  • Improperly removing a building disc;
  • Recklessly performing a spinal fusion;
  • Negligently conducting nerve ablation on the wrong nerves or on unnecessary nerves;
  • Operating at the wrong level (wrong site surgery);
  • Failing to remove all of a calcified disc;
  • Manipulating the spinal cord in a dangerous position;
  • Causing nerve injuries during a procedure;
  • Causing damage to vital vessels or blood structures;
  • Cutting or excessively damaging vital tissue such as nerves or muscles; and
  • Many other causes.

When a healthcare provider causes serious damage to a patient’s back and spinal cord, it can result in catastrophic New York medical malpractice.  This means that some patients may be partially or completely paralyzed, whereas others may be rendered quadriplegic due to a doctor’s negligence.
