Most parents do not think that their child will be injured during labor or delivery.  Unfortunately, there are some children who are victims of catastrophic brain injuries at birth as the result of the negligent action of medical professionals during labor or delivery.  Some of these injuries are unavoidable, but others are caused by the actions or inaction of the medical professionals involved in the labor and delivery.

Professionals who are involved in the labor and delivery of a child must work together and are required to perform their duties with the appropriate level of care.  The safe delivery of a child depends on the quality of prenatal care as well as precise timing.  When health care professionals make mistakes, the child, the mother, or both can suffer irreparable harm.  Negligence in the labor or delivery process can result from:

  • Anoxia (no oxygen)
  • Delayed birth
  • The failure to adequately monitor the fetus
  • Delay in recognizing fetal distress
  • Failing to deliver a child via Caesarean section in a timely manner
  • Forceps injury
  • Failure to effectively use vacuum extractions
  • Hypoxia (oxygen deprivation)
  • Twisting or compression of the umbilical cord

Conditions that may result include:

  • Cerebral palsy
  • Erb’s palsy
  • Brachial plexus injury
  • Paralysis
  • Brain damage

Birth injuries are most tragic when they involve injuries to the brain.  Serious delays in development can result from these injuries.
