Doctor Faces Criminal Charges In Liposuction Death

When most people visit the doctor they do not have a great understanding of the many medical conditions or the treatments that are appropriate for those conditions. They rely on their doctor to give them the best possible care. If a doctor is negligent in providing a patient care and the patient is injured, they may be liable for negligence in a medical malpractice action. Additionally, there are some cases where the doctor could face criminal charges for their negligent actions.

A doctor in Brooklyn, Dr. Oleg Davie, is now facing criminal charges due to his alleged negligent actions in performing liposuction on a patient who had had a heart transplant in the past. These actions led to the death of the patient who went into cardiac arrest after the procedure in May 2012. The doctor is facing charges of manslaughter, criminally negligent homicide, and other charges.

Doctors are discouraged from performing liposuction when a patient has heart disease or a history of heart disease. Dr. Davie allegedly knew of the patient’s medical history and performed the procedure anyways. In order to conceal his knowledge that the patient had had a heart transplant earlier in life, Dr. Davie falsified forms.

Not only is Dr. Davie facing criminal charges and penalties, he may also face a medical malpractice lawsuit should the family sue. When the victim when to Dr. Davie, she expected that he would make the most appropriate decision based on her health history so as to prevent any unnecessary harm. The doctor in this case did not. For this negligence, the family of the victim may decide to sue.

The surviving family members of a victim of medical malpractice may feel a significant amount of grief and sadness after losing a loved one. When a doctor caused the death by failing in their duty of care, the commencement of a medical malpractice lawsuit may not only be appropriate but also necessary. The compensation a medical malpractice lawsuit can bring, if successful, may help the surviving family members to avoid financial hardships that they may be experiencing due to their loved one’s untimely death.
