Medical Malpractice Causing Birth Injuries

Birth Injury

Birth injuries and defects that are caused during labor can be tragic and devastate a family. The process of childbirth is complicated. There are many different ways a newborn can be injured before, during and immediately after labor and delivery. New born babies can be diagnosed with cerebral palsy, brachial plexus injuries, brain injuries, facial paralysis, clavicle or collarbone fractures, broken bones, forceps bruising, and scalp lacerations. Sometimes these injuries can be the result of medical malpractice.

When a baby is injured during delivery due to an obstetricians or other member of the OB/GYN department staff botching the birth through the use of too much force, administration of dangerous drugs resulting in a sick baby, or another type of delivery room mistake, the baby’s quality of life in the future can be forever changed. An obstetrician or birth room assistant may have pulled on the baby’s neck as it came down the birth canal, resulting in shoulder dystocia, which leads to brachial palsy. This means the baby has severe nerve damage at the base of the neck, resulting in the child being unable to walk or has paralyzed arms and hands.

Other motion disorders include cerebral palsy, neonatal encephalopathy, or hypoxic ischemic brain injuries. These conditions impair a baby’s mobility and brain function. These kids do not develop motor skills normally, and they may suffer from severely damaged neurological function when it comes to communication, behavior, intellectual development, and perception.

Birth injuries can be caused in many different ways, including extreme force, rushed delivery, a delay in delivery, twisting the baby, administration of dangerous drugs during labor, or the failure to diagnose a problem with the baby.
