Plastic Surgery Medical Malpractice Lawsuit Obtains $5.1 Million Verdict

Most surgical procedures pose some risk of complications and/or injury. Plastic surgery is no exception. As with other surgeons, plastic surgeons must exercise a high degree of medical competency and care when they treat patients. When a plastic surgeon fails to provide the level of skill, care, and treatment that a reasonable plastic surgeon would provide under similar circumstances and a patient is injured, it may be medical malpractice.

People undergo plastic surgery in order to enhance their quality of life. A botched plastic surgery can result in pain and disfigurement. No one deserves this, regardless of why a person underwent the procedure.

There are many laws and policies that regulate most surgical procedures. However, plastic surgery has a very loose set of regulations. As a result, the plastic surgery industry is full of false advertising, substandard facilities, and doctors with medical credentials that are dubious.

Injuries can occur during plastic surgery procedures such as:

Breast implants (reduction and augmentation)
Rhinoplasty (nose job)
Face-lifts
Eyelid surgery
Botox injections
Brow lifts
Cosmetic jaw or chin procedures
Tummy tucks
Facial implants

An Ohio law firm has obtained a $5.1 million verdict in a medical negligence lawsuit for a woman who allegedly suffered several injuries, including multiple recurrent infections, nerve damage, and permanent scarring, that resulted from a plastic surgery procedure in March 2010. The procedure was performed by Dr. Richard D. Gentile. The jury in this case found Gentile negligent due to his failure to obtain the patient, Kelly Turkoly’s, informed consent and that medical battery was committed in connection with the surgery.
