At The New York Injury & Malpractice Law Firm, P.C., we focus on representing victims of medical malpractice. This means we understand medical malpractice law and the legal process and have extensive experience in litigating medical malpractice cases. We are passionate about helping those injured while under a medical professional’s care and work directly with board-certified physicians in handling cases and claims. Our firm’s hard work, persistence, dedication, and focus leads to results. We have recovered millions of dollars in damages for our clients.

The first thing we do when contacted by a client is evaluate their needs. We pride ourselves on the level of legal services we offer, but in some cases, our office is not equipped to properly handle certain cases. We also know that many attorneys receive calls from potential clients, but feel they are not the right fit for that person. For these reasons, The New York Injury & Malpractice Law Firm, P.C. is proud to participate in a lawyer referral program. Our law office is happy to aid other law firms by offering our services to your clients if you may be unable or unequipped to help a potential client, or continue serving a current client.

To ensure expectations are clear and lines of communication remain open between our firm and the referral partner, we outline our referral system in our Referral Rules of Engagement.

The New York Injury & Malpractice Law Firm, P.C. Referral Rules of Engagement

We are grateful for the many attorneys that trust us with their client’s case and have created a system to manage our referrals. We pride ourselves in this referral system and our methods of communication with partners.

Within 24 hours of the referral, our law firm will contact the client. The referral partner will be notified whether the client was declined, the case is under consideration by our firm, or we were unable to contact the client. Cases that are under consideration are almost always reviewed by John H. Fisher and a board-certified physician. The referral partner will be updated on the work done for the case under review, such as obtaining medical records, reviewing the records with a physician, and the physician’s opinion of the case’s merit.

For cases we accept, the referring attorney or firm will be notified when the summons and complaint are filed, the trial date is scheduled, and a settlement or judgement is reached.

Co-Counsel Agreements

Although a referral is sometimes necessary, a case where another attorney’s help is needed does not always warrant a referral. In this case, it may be best to co-counsel. A co-counsel agreement is a great way for an attorney to call upon the help of another attorney while still maintaining a role in their client’s case.

One of the main reasons an attorney would choose to co-counsel is to gain additional legal knowledge on a case where they are not experienced – such as in medical malpractice cases. Another reason an attorney may choose to co-counsel is to maximize the investigative resources available for a case. These additional resources can be crucial to uncovering evidence.
