Determining whether someone has been a medical malpractice victim is not always easy.  A thorough evaluation of the circumstances surrounding the incident may be required in order to determine if there was a significant medical injury linked to a medical professional’s actions.  Additionally, patients may sign forms that allow them to be treated, which may raise the question of whether the patient’s signature means that s/he assumed the risks.

There are some signs that indication that a person has been the victim of medical malpractice.  If these signs are present, further professional legal support may be needed to take further action.  Medical malpractice has occurred when:

  • An error was made by a medical professional while administering treatment – There are certain standards doctors, nurses, and other medical professionals are expected to adhere to when they provide patients with care.  There is also an assumption that these professionals are competent to perform their job duties without making errors.  When medical mistakes are made there can be serious consequences for patients.  Medical professionals care deemed to have been negligent if such errors are a result of a deviation from the accepted standard of care.
  • The patient suffered an injury due to an error made by a medical professional – When medical professionals make an error, the injuries to patients that result can be very serious.  There may be grounds to file a medical malpractice lawsuit if the patient suffers an injury as a result of a medical professional’s error.  Such injuries can include disfigurement, disability, or pain.
  • The patient incurred damages because of an error that was made by a medical professional – There can be physical, financial, or psychological damages in a medical malpractice case.  Patients will be able to better understand whether they have grounds for a medical malpractice claim once they have received professional help assessing what damages s/he have incurred due to the negligent conduct of a medical professional.
