Birth Injury Lawsuit Settles For $5.25 Million
Birth Injury, CasesThe birth of a child is in most cases a very happy day in the lives of parents. When giving birth to a child parents expect their unborn child to have the best possible care and they do not expect that their child, who has lived for such a short period of time, to be injured during delivery. So when a child is injured due to the negligence of the medical staff during deliver, this happy day can become very tragic.
One mother in Ohio experienced this after her son was delivered by emergency cesarean section. The obstetrician, however, failed to manage the labor properly, taking too long to determine whether a cesarean section was needed. The baby was deprived of oxygen, resulting in the child suffering brain injuries. He will require continual care for his entire life.
During the trial, the court heard persuasive testimony by two doctors. The doctors found fault with how the drug Pitocin, which increases the frequency and intensity of uterine contractions, was administered during the labor. The drug can also decrease the supply of blood and oxygen to the baby, as is what happened in this case.
The family has settled the case for $5.25 million, the second-largest medical settlement paid by Ohio State’s medical center. The obstetrician who committed the error has since retired from practice.
Parents with children who are born with birth injuries, and it is believed that those injuries were the result of medical malpractice, may have grounds for a lawsuit. The compensation parents may receive from such a lawsuit will help immensely when it comes to paying for the ongoing care that will be necessary because of those injuries.
