Failing To Provide Aftercare Can Be Medical Malpractice

Medical Malpractice Mistakes

In New York, if a patient dies or sustains an injury as the result of negligent medical care, then the physician, hospital, or other health care professionals could be liable under the state’s medical malpractice laws. Under these laws, all health care professionals have a legal and ethical obligation to provide the patient with safe and responsible treatment. Inadequate or failure to provide follow-up care may also be considered medical malpractice.

Once a doctor has performed a surgery or administered new medications, or provided the patient with other types of treatment, they need to provide the patient with subsequent aftercare to determine whether the treatment has helped or harmed the patient. Follow-up care is particularly important after a surgical procedure has been performed. This ensures that the patient has begun to heal properly. Failure to provide this care to patients, or leaving the patient to their own devices, can be dangerous to the patient’s health long term.

If complications occur after a patient has undergone surgery or has received medical treatment, and the patient is not provided with adequate follow-up care, then the patient may have grounds for a medical malpractice claim. The circumstances that surround each patient’s malpractice claim can vary. Each case must be evaluated on a case by case basis in order to determine whether a valid claim exists. Patients who have been injured due to a doctor’s breach of duty to provide that patient with a reasonable standard of care can seek compensation for any injuries they have suffered that resulted from the health care provider’s negligence.
