Gynecological Malpractice

Medical Malpractice Mistakes

Negligence on the part of a health care provider is known as medical malpractice.  When a health care provider, such as a gynecologist, departs from the accepted medical practice, resulting in a patient being injured or dying, the health care professional can be held liable for their actions.  In these cases, a patient may be entitled to recover damages.

Gynecologists are doctors who specialize in the reproductive and sexual health care of women.  This includes issues with the reproductive tract, such as the uterus, fallopian tubes, ovaries, cervix, and vagina.

Women generally begin seeing a gynecologist once they reach 21, or sooner if sexually active or have a problem with the reproductive system.  Gynecologists perform a variety of services including breast exams, pelvic exams, and Pap tests.  If a gynecologist does not order the correct test or does not perform the test properly then he or she may be liable for medical malpractice.  The common diseases that are treated by gynecologists include:

  • Acne
  • Cramping
  • Depression
  • Sexually transmitted diseases,
  • Unusual periods, and
  • Weight issues

Issues with the female reproductive system may also require surgery.  All medical operations have risks associated with them, including gynecological operations.  However, these risks can be alleviated through competent gynecologic surgery.  Errors involving a gynecologic surgery can occur during the operation or during pre- or post-operative care.  If the surgeon fails to take the necessary precautions, serious injury can occur.  These errors can result in injury to organs, infection, hemorrhage, infection, surgery on the wrong organ or the wrong side of the body, or perforation of an organ.

Types of gynecologic procedures that can result in serious injury include:

  • Cystocele or rectocele repair
  • Hysterectomy
  • hysteroscopy
  • Laparoscopic surgery
  • Myomectomy
  • Ovarian surgery
  • Tubal ligation
