Hospital Declares Child Dead, 5 Hours Later He Wakes Up!

This is a tragic case that really makes me quite angry! This should NOT happen ever but does far too often. Generally, this will happen when a hospital cuts corners and moves too quickly without giving patients the time and dignity they deserve.

This case involves an out-of-state hospital which declared an 8 year old dead when, in fact, the child was still very much so alive. The patents had found him unresponsive at home and rushed him to the hospital. While there, staff worked on him for 25 minutes as he was in cardiac arrest. They declared him dead, even though his eyes kept flickering open (which the parents were told was part of an involuntary reflex).

But after five hours, the parents were concerned that his eyes were still flickering and it was more than involuntary reflexes. They ordered a cardiac ultrasound which the hospital staff obliged to and found the child with a heartbeat! Staff immediately began to work on him to save his life the best they could—which they did.

However, due to being “discarded,” the child suffered severe brain damage and is permanently. The parents allege that the hospital was negligent in their resuscitation procedures which caused the brain damage, pain and suffering, and familial stress.

Again, this is an absolutely horrifying case to imagine enduring. There is clear negligence here and it is just a matter of the damages. While this case was just filed, and no one is proven guilty, it looks likely for there to be a strong case in damages.
