Hospital Sued After Daughter Is Left Brain-Damaged

Hospitals

When a patient goes to the hospital, he or she expects to leave feeling better. However, even the most routine medical procedures can go awry. One teenager experienced this and is now in a vegetative state. Her parents have filed a lawsuit against the hospital where the daughter underwent the procedure.

Raina Ferraro was taken by her father, Giulio Ferraro, to Phelps Memorial Hospital in Sleepy Hollow, New York because she was complaining of stomach pains. To determine the cause of the pains she underwent an endoscopy. This procedure allows a doctor to look inside the body by using an instrument called an endoscope. This instrument has a tiny camera attached to a long, thin tube. It is moved through a body passageway or opening by the doctor to see inside an organ. According to the lawsuit, things began to go wrong just 20 minutes into the procedure. The Ferraros’ attorney alleges that her heart rate and blood pressure caused a brain injury because of lack of oxygen to the brain and that this could have been prevented.

The hospital and two doctors have been accused of negligence and carelessness in failing to properly administer anesthesia. After the botched procedure, the hospital did not speak to the parents for two weeks, and when they finally did they would not explain what went wrong during the procedure. The Ferraros are seeking an unspecified amount of damages, however caring for their daughter has drained them financially. Their daughter is now being cared for at a children’s hospital in Valhalla.

If you or a loved one has sustained an injury during an endoscopy procedure due to a doctor’s negligence, it is recommended that you find a medical malpractice lawyer. An experienced medical malpractice lawyer will review your situation in order to decide whether there is a potential case, and if so, how to best proceed.
