Do you want a fast, simple way to lose your medical malpractice case in 3 simple steps? Of course not! If you want to win your medical malpractice case, here’s a roadmap for the top 3 steps to AVOID.

The First Way to Lose your Lawsuit

Most injury victims hire a lawyer by calling the first lawyer they happen to see on a TV commercial. HUGE MISTAKE! Although few non-lawyers know this, it is close to common knowledge among lawyers that the TV lawyers (while greater marketers) are not trial lawyers.

What does this mean for you? If you hire a lawyer by calling a “TV lawyer”, you will speak with someone who likely never steps foot into a courtroom. If the TV Lawyer can’t settle your case, he will refer it to a trial lawyer, i.e., a lawyer that will actually represent you in court.

The biggest mistake you can make is failing to do RESEARCH for the best medical malpractice attorney. If you spend a week searching for a quality used car, why wouldn’t you spend at least that much time finding the right lawyer for your case? (that’s a rhetorical question). You should take your search for the best malpractice lawyer seriously.

You must keep on top of your malpractice lawyer. Don’t assume that your lawyer is working diligently on your case! You should be getting updates on the status of your case at least once a month and you should know what your lawyer is doing for you. You should insist on monthly meetings or phone conversations with your lawyer. If your lawsuit has not been filed, find out why and when the statute of limitations will expire. Believe it or not, many malpractice lawyers do not keep track of the date that the statute of limitations will expire on your case. If the statute of limitations expires before you file a lawsuit, you LOSE YOUR RIGHTS FOREVER!

If you aren’t keeping on top of your lawyer, no one else will. Be proactive with your lawyer.

The Third Way to Lose your Lawsuit

Never assume your lawyer has hired the right medical experts to review your case!

In the initial meeting with your lawyer, your lawyer may impress you with his office, cars and fancy suit. None of that stuff matters! What matters is that your lawyer is spending the time to get ALL of your medical records and get a medical expert to review the records to assess the strengths and weaknesses of your case.

You should ask your lawyer, “Have you hired a physician to review my medical records? What is the physician’s opinion about my case? Will this phyician testify in court about his/her opinions?” Within 4 weeks of your initial contact, your lawyer shoud be able to answer these questions. If not, it may be time to find a new lawyer.
