$2.65 Million For A Baby Born With Brain Damage

A baby girl—born with brain damage following obstetrical negligence—recovered $2.65 million dollars in Bronx, NY earlier this month.

The mother of the baby suffered from hypertension and diabetes during her pregnancy and her attorneys alleged that her doctors did not properly manage these conditions.

While in the mother was in labor, the doctors observed that the baby was not receiving enough oxygen and yet they decided not to perform a caesarean section (c-section); which most doctors in this situation would have performed. The baby was later diagnosed with autism.

The doctors’ defense argued the doctors followed the standard of care before, during and after birth. Additionally, they argued that autism could not be linked to oxygen deprivation the baby experienced at birth.

The recovery for the baby girl will assure that she receives medical attention for her disabilities for the rest of her life.
