Signs A Birth Injury Was Caused By Medical Malpractice

Birth injuries are horrible.  Newborns get serious, debilitating, and often permanent injuries right at the start of their live and they have no say to defend against it.  It is just a very said and horrible fact of life that this occurs.  What is even worse is that some of these birth injuries may be caused by medical malpractice.  That is right—even before a baby is born and has a chance at life, a doctor or healthcare provider causes a negligent mistake in the health or treatment of the baby.  While birth injuries do occur naturally, a lot are caused by medical malpractice.

Thus, there are some signs you should be aware of that a birth injury may be caused by medical malpractice.  These include the following:

  • Your baby goes right to the NICU – this is the ICU of babies, and it is very serious, intensive, and specialized treatment.  If your baby goes into the NICU right away, you should be suspicious.
  • Healthcare providers are not talking to you – if it feels like you are invisible in the room even though you are talking and asking questions, that is not a good sign.  Especially when other staff like nurses or technicians are ignoring you, because it is almost like they are waiting for the doctor to say something to you.  This is a sign that something is not right.
  • The doctor has disappeared – if the doctor has disappeared and you have requested for him or her to come back and he or she has not returned, this is also a bad sign in that either 1) your baby needs very serious treatment, or 2) the doctor is avoiding you.  This is a warning sign.
  • Staff does not let you see your baby or does not tell you about your baby – if staff is ignoring the fact that you just have a baby, and ignoring you completely when you ask questions, that is a horrible sign.  You need to demand to see the doctor and it is a sign there could be serious medical malpractice.
