A birth injury is a horrible type of injury.  A newborn baby is one of if not the most vulnerable member of our society.  When negligent acts by a healthcare provider cause permanent and disabling injuries to a baby, it is a travesty and great injustice.  This is why many New York  medical malpractice lawyers specially seek birth injury cases to help families and these innocent victims.

Some common types of birth injuries include the following:

Brachial plexus injuries – this is when the brachial plexus nerves originating from the neck and extending through the shoulder and into the fingers is damaged.  Pulling, yanking, twisting, and other maneuvers on the shoulder or arm of a baby can cause these injuries during the birthing process.

Cerebral palsy – when a baby is in fetal distress, a hypoxia (or lack of oxygen) could result in very serious brain injuries.  These injuries could result in a disorder known as cerebral palsy.  This results in cognitive and functional deficiencies which could result in permanent disability.

Facial paralysis – the use of forceps and vacuums are permitted to help deliver a baby, but when they are excessively used they can result in serious personal injury.  They can also result in permanent nerve damage which results in facial paralysis that can block part of the motor function or sensation in the face.

Kernicterus – this is a very serious type of birth injury that slowly is caused due to hyperbilirubinemia, or a substance which results in jaundice.  While most babies do experience some type of jaundice, when it does not clear up or it is excessive, it can result in brain damage which is permanent and incredibly disabling.
