Understanding the Types of New York Medical Malpractice from Our Kingston Medical Malpractice Lawyer

There are many possible types of New York medical malpractice which could result in serious or permanent injuries to a person.  This includes more known types of medical malpractice like breaking a tool off in a patient during a procedure or slipping with a scalpel, or more hidden types of medical malpractice like a laceration inside a patient during a procedure which is sutured up and hidden or a failure to properly ensure a patient was perfused during a long surgery.  Anytime a healthcare provider fails to comply with the acceptable standard of care that a reasonably prudent provider would have in similar circumstances with similar training, it could be New York medical malpractice.

Misdiagnosis – This is when a healthcare provider fails to diagnose a condition, either through improper tests, not ordering testing, or misreading the tests.  A misdiagnosis can result in very serious personal injuries and even the wrongful death of a patient.  Just think of it this way, if cancer is misdiagnosed and allowed to fester, it could become incurable and kill a patient.  Thus, the longer that a patient’s diagnosis is not treated, the longer that the patient could be suffering from some very devastating condition.

Failure to Treat – Even if a doctor receiver the correct diagnosis, the doctor could fail to treat the condition appropriately.  This could be failing to treat entirely, or it could be a failure to treat within the acceptable standards of care.  Meaning that a patient could be receiving no or poor treatment which will not help the condition.  For example, putting ice on a broken bone will not heal the bone and could result in the bone mending inappropriately without a cast or without surgery, which will then result in the patient needed to have an additional procedure to correct the deformity.

Surgical Errors – This is probably the most thought of type of New York medical malpractice, and it is common.  When a surgeon makes mistakes it can simply be due to careless, reckless, or downright negligent medical care.  This means that a patient could be injured by the mishandling of a doctor or his or her team.  Common surgical errors include during spinal surgeries or joint replacements, particularly lower limb replacements like knee replacements and hip replacements.

Birth Injuries – Birth injuries are catastrophic types of New York medical malpractice and frequently result in life-long injuries.  Birth injuries are usually caused by a condition called hypoxia, which is a lack of oxygen.  This causes damage to the brain, including the parts of the brain which govern motor movement and can result in conditions like cerebral palsy or CP.
