Is It New York Medical Malpractice if a Doctor Fails to Protect Against my Allergy?

If you have an allergy, it can be life-threatening if it triggers.  A patient’s allergy is very serious.  This is why many healthcare providers ask you for your known allergies and mark it all over your medical record.  Sometimes for certain allergies, particularly very dangerous allergies, a hospital or healthcare provider will even mark a patient on the forehead or with a bright colored wrist band of the allergy.  These allergies could be ingested or they could be contact, such as an allergy to taking penicillin or an allergy to latex.  Whatever the allergy is, if a healthcare provider fails to guard against your allergy and it causes your serious personal injuries it could be New York medical malpractice.

Common Reasons Why Doctors Fail to Guard Against a Patient’s Allergy

There are many reasons why doctors fail to guard against your allergies which could result in serious personal injuries or even wrongful death.  Almost all of these reasons are completely avoidable are are likely New York medical malpractice.  Some of the most common reasons for allergy mixups due to New York medical malpractice include the following:

  • Failure to communicate between staff;
  • Failure to ask the patient of the allergy;
  • Misdocumenting the medical chart;
  • Failing to document the medical chart;
  • Mixing up patients;
  • Mixing up allergies;
  • Confusing medications and interactions;
  • Failing to ensure that patient’s with severe allergies are marked;
  • Failing to perform a “time out” prior to starting a procedure;
  • Using the wrong equipment during a surgery, such as latex gloves for a patient with a latex allergy; and
  • Many other possible causes.
